1 Agreement to these terms

These Terms of Service, together with any documents they reference (collectively, the "Terms"), form a binding agreement between you and VelaVia ("VelaVia," "we," "us," or "our") and govern your use of the JungleCart application on Android (app id com.velavia.junglespace), the JungleCart web version, and this marketing website at junglecart.app (collectively, the "App"). These Terms also serve as the End User License Agreement (EULA) for the App.

By downloading, installing, opening, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, Cookie Policy, and Acceptable Use Policy, each incorporated here by reference. If you do not agree, please do not use the App.

2 What JungleCart is

JungleCart is a free parody, satire, and novelty entertainment app. It is a "fake shopping" game designed to deliver the fun of browsing, adding to cart, and "checking out" without any of the real-world consequences. It exists for amusement and commentary, not to sell you anything.

Everything in the App that looks like a store is fictional theater. Specifically:

• Products are illustrative demo data, not real inventory. Their names, images, and descriptions are pulled from public sample APIs and are not offers to sell anything.
• Prices are made-up numbers in pretend currency.
• Orders, checkout, delivery, and tracking are simulations. No order is ever placed with anyone, no warehouse is involved, and no package exists.

3 Eligibility & age

The App is intended for a general audience but is not directed to children. Because it displays third-party ads and simulates commerce and spin-style game mechanics, you must be at least 13 years old to use it.

If you are in the European Economic Area (EEA) or the United Kingdom, you must be at least 16 years old, or have consent from a holder of parental responsibility, to the extent required for the ad-related data processing described in our Privacy Policy.

By using the App you represent that you meet these age requirements and that your use of the App does not violate any law or regulation that applies to you. If you are using the App on behalf of someone else, you represent that you are authorized to accept these Terms on their behalf.

4 No real commerce

This is the most important thing to understand about JungleCart, so we will be blunt about it.

Because there is no real commerce:

• You are never entering into a purchase, sale, or contract for goods when you "buy" something in the App.
• There is nothing to return, refund, cancel, dispute, or reimburse, because no money ever changed hands.
• Consumer protections that apply to real retailers (delivery guarantees, warranties on goods, order fulfilment obligations, and similar) do not apply, because JungleCart does not sell or ship anything.
• Any resemblance to a real online store — including layout, categories, "deals," and "free shipping" — is part of the parody and is not a representation that any real product or service exists.

If any part of the App ever appears to ask you for payment card details or real payment, do not enter them — that is not how JungleCart works, and you should report it to us.

5 Virtual currency & in-game items

The App uses a pretend, in-game currency — variously shown as "fake dollars," coins, or your balance — along with in-game items such as cart contents, "orders," a virtual mansion, and streaks (collectively, "Virtual Items"). Virtual Items exist only inside the game.

You acknowledge and agree that:

• Virtual Items have no monetary or real-world value whatsoever.
• Virtual Items are provided free of charge. VelaVia does not sell them, and you never pay real money for them.
• Virtual Items are non-transferable, non-redeemable, and non-cashable. They cannot be cashed out, redeemed, exchanged, transferred, or converted into money or anything of real value, and you have no ownership or property right in them.
• VelaVia may, at any time and without notice or liability, modify, reset, regrant, or remove in-game balances and Virtual Items — for example when we update the game, fix a bug, or rebalance mechanics.
• Your Virtual Items and game progress are stored locally on your device. Clearing the App's data or uninstalling the App will erase them permanently, and they cannot be recovered by us because we do not store them.

The App does not currently sell any items for real money. If VelaVia ever chooses to offer optional paid items in the future, those purchases would be handled through the applicable app store (for example, Google Play) and would be governed by that store's payment terms, refund rules, and policies, in addition to these Terms.

6 The prank / gift feature

The App includes a feature that lets you generate a shareable "gift card" link and pass it to a friend as a joke. This link contains only the text you type into it — for example, a sender name and a pretend amount — and you share it using your device's normal operating-system share sheet.

You are solely responsible for the content you enter and for how, where, and with whom you share these links. When you use this feature, you agree that:

• You will comply with our Acceptable Use Policy and all applicable laws.
• You will not use it to harass, deceive for gain, defraud, impersonate, or harm anyone.
• You will not include real sensitive or personal information — such as real financial details, passwords, or another person's private data — in the name, amount, or message fields.

7 Acceptable use

Your use of the App is subject to our Acceptable Use Policy, which forms part of these Terms. In short, you agree not to misuse the App or use it to harm others. Among other things, you agree that you will not:

• Use the App for any unlawful, fraudulent, deceptive, or harmful purpose, or to mislead anyone into believing JungleCart is a real store or that its currency has value.
• Reverse engineer, decompile, tamper with, or attempt to defeat the security, integrity, or fake economy of the App, except to the limited extent such restriction is prohibited by applicable law.
• Use bots, scrapers, automation, or exploits to interfere with the App, the ads it shows, or the demo APIs it fetches from.
• Copy, distribute, resell, or create derivative works of the App or its content except as expressly permitted.
• Use the App in a way that infringes the rights of, or restricts or inhibits the use and enjoyment of the App by, any third party.

8 Intellectual property

The App — including its software, code, design, layout, "JungleCart" name, logos, copy, and other original content — is owned by VelaVia or its licensors and is protected by intellectual-property and other laws. Subject to your compliance with these Terms, VelaVia grants you a limited, personal, non-exclusive, non-transferable, revocable license to access, download, and use the App for your own personal, non-commercial entertainment. All rights not expressly granted are reserved.

Third-party content. Product names, images, and descriptions shown in the App are illustrative demo data fetched from third-party sample APIs. That demo data, and any brand names, logos, or trademarks that may appear within it, belong to their respective owners. VelaVia claims no ownership of it.

Parody and no affiliation. JungleCart is a work of parody, satire, and commentary. It is not affiliated with, endorsed by, or sponsored by Amazon or any real retailer or brand. Any resemblance to a real store, service, or trademark is intended as parody and commentary and is used, where any third-party mark appears at all, on a nominative or fair-use basis to make the joke land — not to suggest any association or approval.

9 Third-party services

The App relies on a small number of third-party services, and your use of the App may be subject to their terms and privacy practices in addition to ours. We do not control these third parties and are not responsible for their services, content, or data practices.

For full detail on what data flows to these services and how to limit ad personalization, see our Privacy Policy. You can reduce ad tracking by resetting or deleting your Advertising ID and turning off ad personalization in Android Settings > Privacy > Ads.

10 Disclaimers

The App is provided "as is" and "as available," with all faults and without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, VelaVia disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranties arising from course of dealing or usage of trade.

Any content fetched from third-party demo APIs is provided by those third parties, may be inaccurate or offbeat, and is included only as illustrative filler for the parody. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you; in that case, such warranties are limited to the minimum extent permitted by law.

11 Limitation of liability

To the fullest extent permitted by law, in no event will VelaVia or its officers, employees, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the App — even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, VelaVia's total aggregate liability arising out of or relating to the App and these Terms will not exceed the greater of (a) the total amount you actually paid VelaVia for the App in the twelve months before the claim, which for a free app is zero, or (b) [nominal cap amount].

12 Indemnification

You agree to indemnify, defend, and hold harmless VelaVia and its officers, employees, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms or of the Acceptable Use Policy; (c) content you create or share, including any gift-card links you generate; or (d) your violation of any law or of the rights of any third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.

13 Suspension & termination

These Terms apply while you use the App. Because the App requires no account and stores your progress only on your device, you may end this agreement at any time by simply stopping use of the App and uninstalling it or clearing its data — which also erases your local game progress and Virtual Items.

We may suspend, limit, or terminate your access to the App, or discontinue the App in whole or in part, at any time and for any reason — including if we believe you have violated these Terms or the Acceptable Use Policy, or to comply with law or an app store's requirements. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — will survive.

14 Changes to the app & these terms

The App is under active, playful development. We may add, change, remove, or reset features, content, game mechanics, and Virtual Items at any time without notice or liability. We may also stop offering the App entirely.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and post the new version at this address. Material changes will take effect when posted, and your continued use of the App after an update means you accept the revised Terms. If you do not agree to a change, your remedy is to stop using the App.

15 Governing law & dispute resolution

These Terms and any dispute or claim arising out of or in connection with them or the App are governed by the laws of [governing-law jurisdiction], without regard to its conflict-of-laws rules. You and VelaVia agree to submit to the exclusive jurisdiction of the courts located in [governing-law jurisdiction] to resolve any such dispute, except where applicable mandatory law gives you the right to bring proceedings in the courts of your place of residence.

Before filing any formal proceeding, we encourage you to contact us so we can try to resolve the matter informally. Nothing in these Terms affects any statutory rights or consumer protections that apply to you and cannot be waived by agreement.
