VelaVia LLC ("VelaVia," "we," "us," or "our") respects your privacy. This Privacy Policy explains how we collect, use, share, and protect information when you (a) visit velavia.io or any VelaVia website, (b) download or use any of our mobile applications or games — including Battery Panic, FlipDraw, SumMatch, Slapphone, Prankphone, GetSpark, and any other app or game published by VelaVia on the Google Play Store, Apple App Store, or direct download — (c) use VelaVia AI — our AI application at velavia.io/ai, including AI chat, image, video, voice, and music generation and feature experiences such as Custom Songs, Kids Sports Trading Cards, and AI Pet Videos — and (d) contact us through any form, email, or support channel. We refer to all of the above collectively as the "Services."
By using the Services, you agree to the collection and use of information in accordance with this Policy. If you do not agree, please do not use the Services.

Some of our free-to-play apps and games display advertising from third-party ad networks and use third-party analytics SDKs. Depending on the app, these may include:
These third parties may use your device's advertising ID, IP address, and in-app activity to show you more relevant ads and measure ad performance. They operate under their own privacy policies. You can limit ad tracking at any time:
If an app includes a paid "Remove Ads" option, purchasing it will disable third-party ads in that app for your device.
Our websites use cookies and similar technologies (local storage, pixels) to remember your preferences, analyze traffic, and — where you consent — measure marketing performance. You can instruct your browser to refuse cookies, though some parts of the site may not function properly as a result. We do not use cookies inside our mobile apps and games; mobile data collection is covered in Sections 2(c) and 5.
Purchases inside VelaVia apps and games are processed by the platform store (Google Play Billing on Android, Apple StoreKit on iOS). VelaVia never sees or stores your full credit card number, bank details, or billing address. We receive only a validated purchase token and the SKU purchased, which we use to grant the corresponding entitlement (e.g., "Remove Ads"). Refunds are handled by the platform store according to the store's refund policy.
We do not sell, rent, or trade your personal information. We may share information only in the following limited cases:
We keep personal information only as long as necessary for the purposes described in this Policy or as required by law. Website contact-form submissions are retained for customer-relationship management purposes. Gameplay data (scores, progress, settings) is stored locally on your device and is deleted when you uninstall the app. Server-side analytics and crash reports are retained by our service providers according to their standard retention policies (typically 14 months for Google Analytics, 90 days for Crashlytics crashes).
VelaVia AI content. Your VelaVia AI account content — including your prompts, uploaded photos and audio, and generated outputs — is retained in your account until you delete it or close your account, so that you can view and re-download it. You can delete individual items, or request deletion of your account and all of its content, at any time (see Section 12, Your Rights, and the Contact section below). Source photos uploaded only to create a one-time result (such as a trading card or pet video) are kept only as long as needed to generate and deliver that result and to let you re-download it, and are deleted on request. When you delete content, we remove it from your account and request its deletion from our processors; residual copies may persist in encrypted backups for a limited period before they are overwritten.
We implement industry-standard technical and organizational measures to protect personal information, including TLS encryption in transit, restricted access to production systems, and secure credential storage. However, no method of transmission over the internet or method of electronic storage is 100% secure, and we cannot guarantee absolute security.
VelaVia is based in the United States. If you access the Services from outside the U.S., your information will be transferred to, stored, and processed in the United States. Where required by law, we rely on appropriate safeguards (such as Standard Contractual Clauses) for international transfers.

California residents have the right to know what personal information we collect, the right to delete it, the right to correct it, the right to opt out of "sale" or "sharing" of personal information, and the right to non-discrimination for exercising these rights. VelaVia does not sell personal information. Some advertising activity inside our free apps may be considered "sharing" for cross-context behavioral advertising under the CPRA; you can opt out by following the ad-tracking opt-out steps in Section 5 above, or by emailing us.
Our services, websites, and most of our apps and games are not directed to children under 13 (or under 16 in the EU/UK). We do not knowingly collect personal information from children in those age groups. Where a game is rated "Everyone" on Google Play and is suitable for general audiences, we still follow Google's Families Policy and Apple's equivalent requirements: no personalized advertising to users we know to be children, and no collection of data beyond what is necessary to run the game. If you are a parent or guardian and believe your child has provided us with personal information, please contact us at contact@velavia.io and we will delete the information.
VelaVia AI and photos of children. VelaVia AI accounts are for adults. The Kids Sports Trading Cards feature is designed to be used by a parent or legal guardian who chooses to upload a photo of their own child to create a keepsake. We do not permit children to create VelaVia AI accounts, and we process a child's photo only as directed by the adult account holder, who confirms they are the child's parent or legal guardian and consents to that processing. We use a child's photo solely to generate the content you request; we do not use it for advertising or facial recognition, and — where a provider offers the option — we instruct our AI providers not to use submitted content to train their models. We delete a child's photo on request. If you believe a child's photo or information was provided without proper authority, contact us and we will delete it.
Our websites and apps may contain links to third-party websites, stores, or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review their privacy policies before providing them with your information.
VelaVia AI generates content by sending your Inputs to third-party artificial-intelligence providers and returning their output to you. This section explains how that works and how your information is handled.
Third-party AI providers. To fulfill your request, we transmit your Inputs — including your prompts and any photos or audio you upload — to third-party AI model providers, which may include OpenAI, Anthropic, Google, and specialized image, video, music, and voice-generation providers. These providers process your Inputs to produce a result and handle that data under their own privacy policies and terms. We encourage you to review the policies of the major providers, including OpenAI, Anthropic, and Google.
Model training. Where a provider offers the option, we use their services under terms that do not permit them to use your submitted content to train their models. We also do not use your prompts, uploads, or generated content to train our own foundation models. We cannot, however, control third-party practices, so please review each provider's policy.
Photos and face data. Photos you upload may contain faces. We and our AI providers use those photos only to generate the content you request (for example, a stylized trading card or a pet portrait or video). We do not use facial-recognition technology to identify individuals, we do not create or store biometric identifiers or face-geometry templates from your photos, and we do not sell face or photo data. If you are in a jurisdiction with a specific biometric-privacy law (such as Illinois' Biometric Information Privacy Act), note that these features stylize or animate images and are not used to identify anyone.
Payments. Paid VelaVia AI subscriptions are handled by a third-party payment processor (for example, Stripe), which collects and processes your payment information under its own privacy policy. VelaVia receives only limited billing information and never your full payment-card number.
Your controls. You can view and delete your VelaVia AI prompts, uploads, and generated content from your account, and you can request deletion of your account and its content at any time by contacting us (see Section 12, Your Rights, and the Contact section below).
We may update this Privacy Policy from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and, where required by law, notify you through the app or by email. Continued use of the Services after changes constitutes acceptance of the updated Policy.
