Terms of Service

These Terms are the agreement between you and VelaVia, LLC for using GasIQ. We keep them plain-English on purpose. The most important promise comes first: GasIQ never sells your driving, location, or financial data — not to advertisers, not to insurers, not to anyone.

1. Acceptance of these Terms

GasIQ is published by VelaVia, LLC ("VelaVia," "we," "us," or "our"), based in Sacramento, California, USA. By downloading, installing, creating an account on, or using the GasIQ mobile app or related services (together, the "Service"), you agree to these Terms of Service ("Terms") and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Service.

If you use GasIQ on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Eligibility

GasIQ is not directed to children. You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use GasIQ only with the involvement and consent of a parent or legal guardian who agrees to these Terms. By using GasIQ, you confirm that you meet these requirements.

3. What GasIQ does

GasIQ is an honest gas-price and fuel-decision app. Depending on the features you use, the Service can:

• Show nearby gas stations and estimated prices, and compute a "true" effective price after factoring in detour, your vehicle's MPG, and your reward-program stack.
• Plan cheaper ways to fuel your trips.
• Let you log fill-ups (gallons, price, odometer) and optionally snap a receipt or pump photo to read those numbers automatically.
• Track your fuel spending, savings, and vehicle details.
• Surface vehicle recall information sourced from NHTSA.

We're launching on iOS first, with Android to follow. We may add, change, or remove features over time. The Service is provided for your personal, informational use.

4. Gas prices are estimates — always verify at the pump

Station locations, prices, reward calculations, MPG figures, route detours, and "true price" comparisons are all estimates intended to help you make a decision. They may differ from the actual price you pay for many reasons, including timing, station changes, fuel grade, promotions, taxes, payment method, and data errors. GasIQ and VelaVia are not responsible or liable for any difference between a price shown in the app and the price you are actually charged, or for any decision you make based on the app's estimates. You are responsible for confirming the real price before purchasing fuel.

5. Not financial, tax, or investment advice

GasIQ helps you understand fuel costs and potential savings, but it is not a financial, tax, accounting, or investment advisor, and nothing in the Service is professional advice. Savings figures, projections, and recommendations are illustrative estimates, not guarantees of any outcome. For decisions with financial consequences, use your own judgment and consult a qualified professional where appropriate.

6. Your account and security

GasIQ uses passwordless, email-based sign-in. You're responsible for keeping access to your email and device secure and for activity that happens under your account. Please give accurate information and keep it current. Tell us promptly at tommy@velavia.io if you believe your account has been accessed without your permission. You can permanently delete your account anytime from Profile → Delete account in the app, which removes your account and the data synced to our servers.

7. Acceptable use

When you use GasIQ, you agree not to:

• Break any law, or infringe anyone's rights, with the Service.
• Reverse-engineer, decompile, scrape, or attempt to extract source code or underlying data, except where the law expressly allows it.
• Probe, overload, disrupt, or interfere with the Service, our servers, or our data providers, or try to gain unauthorized access.
• Use bots, automated scripts, or bulk methods to access or harvest data from the Service.
• Upload content that is unlawful, infringing, malicious, or that you don't have the right to share.
• Resell, rent, or commercially exploit the Service or its data without our written permission.
• Misrepresent or knowingly submit false station, price, or fill-up data.

8. Subscriptions, billing, and free trials

Core GasIQ features are free, supported in part by ads (see Section 9). We also offer optional paid subscriptions:

• GasIQ Pro — 7.99 USD per month.
• GasIQ Driver-Pro — 12.99 USD per month.
• A 3-day free trial may be offered. If you don't cancel before the trial ends, it converts to a paid subscription and you'll be charged.

Billing is handled entirely by Apple (App Store) or Google (Google Play), not by GasIQ. When you subscribe:

• Payment is charged to your Apple or Google account at confirmation of purchase.
• Subscriptions auto-renew at the then-current price each period unless you cancel at least 24 hours before the current period ends.
• You manage and cancel your subscription in your App Store or Google Play account settings — not inside GasIQ. Deleting the app alone does not cancel a subscription.
• Refunds and renewal terms are governed by Apple's or Google's policies. We generally cannot issue refunds for store-billed purchases; please direct refund requests to the applicable store.

Prices are in U.S. dollars and may vary by region or change over time; any price change will be applied in line with the store's rules and will not take effect until your next renewal after notice.

9. Ads on the free tier

The free tier shows ads through Unity Ads. Consistent with our honesty commitments, these ads use Apple's SKAdNetwork only — there is no IDFA, no cross-app tracking, and no App Tracking Transparency prompt. A subscription removes ads. The app may also offer a rewarded ad that unlocks temporary Pro access; that's optional and entirely up to you.

10. Your content and the license you give us

"Your Content" means the data you put into GasIQ — vehicle details, fill-up logs, savings, reward preferences, and any receipt or pump photos you choose to capture. You keep ownership of Your Content.

You grant VelaVia a limited, non-exclusive, worldwide, royalty-free license to host, store, process, and display Your Content solely to operate and provide the Service to you — for example, to sync your fill-ups and profile across your sessions and to compute your savings. Most data stays local on your device; when you're signed in, fill-ups, profile, and savings sync to our servers.

If you capture a receipt or pump photo, it is sent to our AI vision provider (OpenAI) solely to read the gallons, price, and total. GasIQ does not use your photos to train AI models, and we do not sell Your Content. You're responsible for having the right to share anything you upload, and for not including others' personal information in photos. 11. Third-party services

GasIQ relies on third parties to function, and your use of those features is also subject to their terms and privacy practices. These include:

• Apple App Store and Google Play — app distribution, subscriptions, and billing.
• OpenAI — reading gallons/price/total from receipt and pump photos.
• Unity Ads — free-tier ads (SKAdNetwork only).
• OpenStreetMap / Overpass and Photon / Nominatim — station and address data.
• NHTSA — vehicle recall data.
• Our web hosting provider.

We don't control these services and aren't responsible for them, but we choose them in line with our honesty commitments. Data quality from sources like OpenStreetMap and crowd-sourced prices can vary — see Section 4.

12. Intellectual property

The GasIQ app, the GasIQ and VelaVia names and logos, the "Smart Price" concept and branding, and all software, design, text, and graphics we provide are owned by VelaVia or our licensors and are protected by intellectual-property laws. We grant you a personal, limited, revocable, non-transferable, non-exclusive license to use the Service as intended by these Terms. We reserve all rights not expressly granted. Third-party data and trademarks (for example, station brands and reward programs) belong to their respective owners.

13. Disclaimers of warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any prices, locations, savings, recall data, or other information will be accurate, complete, or current. As stated in Section 4, gas prices are estimates — verify at the pump.

14. Limitation of liability

To the fullest extent permitted by law, VelaVia and its members, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, or lost data, arising out of or relating to your use of (or inability to use) the Service — including any reliance on estimated prices or savings — even if we've been advised such damages are possible.

To the fullest extent permitted by law, our total liability for all claims relating to the Service will not exceed the greater of (a) the amount you paid VelaVia for the Service in the 12 months before the claim, or (b) 50 USD. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

15. Indemnification

You agree to defend, indemnify, and hold harmless VelaVia and its members, employees, and agents from any claims, damages, losses, liabilities, and reasonable legal fees arising out of or related to your misuse of the Service, your violation of these Terms or applicable law, your Content, or your violation of anyone else's rights.

16. Termination

You can stop using GasIQ anytime and delete your account in-app at Profile → Delete account. We may suspend or terminate your access if you breach these Terms, misuse the Service, or where we must to comply with law or protect the Service and its users. If your account ends, the sections that by their nature should survive — including content licenses you've granted, disclaimers, limitation of liability, indemnification, and governing law — will continue to apply. Remember that cancelling a store subscription is done in your App Store or Google Play settings (Section 8).

17. Governing law and dispute resolution

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You and VelaVia agree to first try to resolve any dispute informally by contacting us at tommy@velavia.io; most issues can be sorted out quickly. If a dispute can't be resolved informally, it will be subject to the exclusive jurisdiction of the state and federal courts located in Sacramento, California, and you consent to venue there, except where applicable law gives you the right to bring a claim elsewhere. Nothing here limits any non-waivable consumer rights you have under the law where you live.

18. Changes to these Terms

We may update these Terms as GasIQ evolves. When we make material changes, we'll update the "Last updated" date above and, where appropriate, give in-app or other notice. Your continued use of the Service after changes take effect means you accept the updated Terms. If you don't agree, please stop using GasIQ and delete your account.
