Terms of Service
Effective July 1, 2026
These Terms govern your access to and use of The 1% (the “App”), operated by Velavia (“we,” “us,” “our”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 18 years old and able to form a binding contract. The 1% is a verified, members-only network; we may require verification and may decline or revoke membership at our discretion.
2. The service
The 1% is a private members’ network. It offers:
- Membership — a one-time purchase that grants a verified member profile.
- 1% Network Access — an auto-renewing annual subscription that unlocks the verified member directory and private messaging.
Features may change over time. We may add, modify, or discontinue parts of the service.
3. Purchases, pricing & refunds
- All purchases are made through Apple (App Store) or Google (Google Play) and are subject to their terms. We do not process payments or store card details.
- Membership is a one-time, non-consumable purchase.
- 1% Network Access is an auto-renewing annual subscription (US$999 per year, or the equivalent shown at the point of sale). It renews automatically for another year unless you cancel at least 24 hours before the end of the current period, and your store account is charged for renewal within 24 hours before the period ends.
- Managing or cancelling. You can manage or cancel the subscription anytime in your App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Prices are shown at the point of sale and may change with notice. Purchases are generally non-refundable except where required by law or granted by Apple or Google under their refund policies; refund requests are handled by the applicable store.
4. Your account
You access the App with Sign in with Apple (iOS) or Sign in with Google (Android). You are responsible for activity under your account and for keeping your device secure. Notify us promptly of any unauthorized use.
5. Member conduct
You agree not to:
- Harass, threaten, defraud, or impersonate anyone;
- Send spam, mass solicitations, or unlawful, deceptive, or fraudulent offers;
- Post or transmit content that is illegal, infringing, or violates others’ rights;
- Scrape, harvest, or misuse other members’ information, or share it outside the App without consent;
- Attempt to breach, probe, or disrupt the App’s security or infrastructure;
- Use the App to launder money, evade sanctions, or for any unlawful purpose.
We may remove content and suspend or terminate accounts that violate these Terms.
6. Your content
You retain ownership of the messages and profile content you create. You grant us a limited license to host, process, and display that content solely to operate the App. You are responsible for the content you share and for ensuring you have the right to share it.
7. Verification & exclusivity
Membership is a privilege, not a right. We may verify members and may suspend or revoke access — without refund — for conduct that harms the network, breaches these Terms, or undermines the trust the network depends on.
8. Termination
You may stop using the App at any time and request account deletion. We may suspend or terminate access for breach of these Terms or as required by law. Sections that by their nature should survive termination will survive.
9. Disclaimers
The App is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that any connection will lead to any outcome.
10. Limitation of liability
To the fullest extent permitted by law, Velavia will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or opportunities, arising from your use of the App. Our total liability for any claim will not exceed the amount you paid us for the App in the 12 months before the claim.
11. Indemnification
You agree to indemnify and hold Velavia harmless from claims arising out of your content, your use of the App, or your violation of these Terms or applicable law.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which Velavia is established, without regard to conflict-of-laws rules, and disputes will be resolved in the courts of that jurisdiction — except where applicable law gives you the right to bring proceedings elsewhere.
13. Changes
We may update these Terms. Material changes will be reflected by a new effective date and, where appropriate, in-app notice. Continued use after changes take effect constitutes acceptance.
14. Account deletion
You may delete your account and its associated data at any time. To request deletion, email contact@velavia.io from the email address on your account (or include your membership serial), and we will process the request promptly.
When you delete your account, we remove or anonymize your profile, connections, and messages within 30 days — except limited records we must retain for legal, security, or financial (purchase) purposes, as described in our Privacy Policy. Deleting the App from your device does not by itself delete your account, and cancelling a subscription (done in your App Store or Google Play account settings) is separate from deleting your account.
